5. LICENSE FEE

5.7.2. The Licensee is advised that under no circumstances shall the funds be subject to return if:

7.4. The Licensor is not responsible for the disclosure of information that arose through no fault of the Licensor or became necessary under the legislation of the Republic of Belarus at the request of authorized state bodies.

8. FORCE MAJEURE

8.1. Neither party is liable to the other party for non-fulfillment of obligations caused by circumstances that arose beyond the will and desire of the parties that cannot be foreseen or avoided, including failures of the Instagram social network, declared or actual war, civil unrest, epidemics, blockade, earthquakes, floods, fires and others natural disasters.

8.2. A party that cannot fulfill its obligations must notify the other party of the obstacle and its impact on the fulfillment of obligations under the Agreement within 5 (five) days from the moment of occurrence of these circumstances. 8.3. A Party that has not notified the other Party in a timely manner about the occurrence of force majeure circumstances is deprived of the right to refer to such in justification of non-fulfillment or improper fulfillment of the obligations assumed under this Agreement.

9. DISPUTE RESOLUTION PROCEDURE

9.1. All disputes and disagreements that may arise between the Parties on issues that have not been resolved in the text of the Agreement must be resolved through negotiations.

9.2. The Parties are obliged to comply with the claims procedure for dispute resolution. The term of consideration of the claim is 30 (thirty) calendar days from the date of receipt of the claim, unless another procedure for pre-trial settlement is established by the current legislation.

9.3. If disputes are not settled during negotiations, disputes arising from the Contract are resolved in court.

10. TERM OF THE CONTRACT. TERMINATION OF THE CONTRACT

10.1. The Contract comes into force from the moment of its acceptance in accordance with clause2.3.

10.2. The contract is concluded for an indefinite period.

11. TERMINATION OF THE CONTRACT

11.1 The Contract may be terminated prematurely:

11.1.1. By agreement of the Parties in the manner prescribed by law.

11.1.2. The Licensor has the right to unilaterally terminate the Agreement out of court in case of violation by the Licensee of the terms of this Agreement.

11.1.3. The Licensee has the right to refuse to use the Service at any time. At the same time, the funds written off as payment for the month in which the decision was made to refuse to use the Service are not subject to recalculation and partial refund.
